Is Weed Legal in Florida in 2026?

Medical cannabis is legal in Florida, but recreational marijuana is not. Florida has one of the largest medical cannabis programs in the country, with over 800,000 registered patients. However, a 2024 ballot measure to legalize recreational use (Amendment 3) fell short of the required 60% supermajority, keeping adult-use cannabis illegal for now.

Medical Cannabis in Florida

Florida voters approved Amendment 2 in November 2016 with 71% support, establishing a comprehensive medical marijuana program. The Florida Department of Health’s Office of Medical Marijuana Use (OMMU) oversees the program.

  • Age requirement: 18+ with a valid Medical Marijuana Use Registry ID card (minors with caregiver and two physician certifications)
  • Qualifying conditions: Cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn’s disease, Parkinson’s disease, multiple sclerosis, chronic nonmalignant pain, and other debilitating conditions as determined by a qualified physician
  • Possession limits: A 70-day rolling supply as determined by the recommending physician; 2.5 ounces of smokable flower per 35-day period
  • Where to buy: Licensed Medical Marijuana Treatment Centers (MMTCs) only — Florida uses a vertically integrated model where the same companies grow, process, and sell

How to Get a Medical Marijuana Card in Florida

  1. Schedule an appointment with a qualified physician registered with the OMMU
  2. The physician evaluates you and, if appropriate, enters your certification into the Medical Marijuana Use Registry
  3. Apply for your registry ID card through the OMMU website ($75 fee)
  4. Once approved, you can purchase from any licensed MMTC
  5. Certifications must be renewed every 210 days; the card itself renews annually

What About Recreational Cannabis in Florida?

Amendment 3 appeared on the November 2024 ballot, seeking to legalize recreational cannabis for adults 21 and older. While it received majority support (around 57%), it fell short of Florida’s 60% threshold required for constitutional amendments. As of 2026, recreational marijuana remains illegal.

Possession of cannabis without a medical card is a criminal offense in Florida:

  • Under 20 grams: Misdemeanor, up to 1 year in jail and $1,000 fine
  • Over 20 grams: Felony, up to 5 years in prison and $5,000 fine

CBD and Delta-8 in Florida

Hemp-derived CBD products (with less than 0.3% THC) are legal in Florida under the 2018 Farm Bill. Delta-8 THC products derived from hemp have been available, though the regulatory landscape continues to evolve. Always check current state guidance before purchasing Delta-8 products.
